Terms of Service

Agreement to Terms

By accessing or using the BabyLog mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the App.

Subscription Required

BabyLog requires an active subscription to access all features. By subscribing, you agree to:

• Pay the subscription fee (€1.99/week after a 3-day free trial)
• Automatic renewal unless canceled at least 24 hours before the end of the current period
• Charges to your Apple ID account upon confirmation of purchase
• Subscription management and cancellation through your Apple ID account settings

No refunds will be provided for unused portions of a subscription period.

Free Trial

New users are eligible for a 3-day free trial. If you do not cancel before the trial ends, you will be automatically charged for the subscription. You may cancel at any time during the trial period without charge.

Account Responsibilities

When you create an account with us, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Use the App only for lawful purposes

Acceptable Use

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Upload malicious code, viruses, or harmful content
• Reverse engineer, decompile, or disassemble the App
• Use the App to harm, harass, or violate the rights of others
• Share your account with others or create multiple accounts

Intellectual Property

The App and its original content, features, and functionality are owned by BabyLog and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of the data you input into the App.

Medical Disclaimer

IMPORTANT: BabyLog is a tracking and organizational tool. It does not provide medical advice, diagnosis, or treatment. The App's predictions and insights are for informational purposes only and should not replace professional medical advice. Always consult with a qualified healthcare provider for medical concerns about your baby.

Data Accuracy

You are responsible for the accuracy of the information you enter into the App. We are not liable for any consequences resulting from inaccurate data entry or reliance on the App's analytics.

Service Availability

We strive to provide continuous access to the App, but we do not guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time with or without notice. We will not be liable for any modification, suspension, or discontinuance of the App.

Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the App will immediately cease. You may delete your account at any time through the App settings.

Limitation of Liability

To the maximum extent permitted by law, BabyLog shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code that may be transmitted through the App
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

Indemnification

You agree to indemnify, defend, and hold harmless BabyLog and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

Privacy Policy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts in the Netherlands.

Apple App Store

If you access the App through the Apple App Store, you acknowledge and agree that:

• These Terms are between you and BabyLog, not Apple
• Apple has no obligation to provide maintenance or support services
• Apple is not responsible for any product warranties
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
